Acceptance of Terms

Welcome to Tsubaki Pastry Studio. These Terms of Service ("Terms") constitute a legally binding agreement between you and Tsubaki Pastry Studio regarding your use of our educational platform, courses, workshops, and related services. By creating an account, enrolling in courses, or using any of our services, you agree to comply with and be bound by these Terms.

If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and your continued use of our services following any changes indicates your acceptance of the modified Terms.

Eligibility and Account Registration

You must be at least 16 years of age to create an account and use our services independently. Users under 16 may access our services only with parental or guardian consent and supervision. By registering, you represent that all information provided is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Course Enrollment and Access

When you enroll in a course or purchase a membership, you receive a limited, non-exclusive, non-transferable license to access the course materials for your personal, non-commercial use. Course access is granted for the duration specified in your purchase, which may be lifetime access, annual access, or another defined period.

Live workshop sessions have limited capacity and are available on a first-come, first-served basis. Studio workshops in Osaka require advance booking and may be subject to cancellation due to instructor availability, weather conditions, or other unforeseen circumstances. We will make reasonable efforts to reschedule or provide alternative arrangements in such cases.

Payment Terms and Pricing

All prices are listed in the applicable currency and are subject to change without notice. By providing payment information, you authorize us to charge the applicable fees for courses, memberships, ingredient kits, and other services. Payment is due at the time of enrollment unless otherwise specified.

Membership subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to membership benefits until that time.

Refund and Cancellation Policy

We offer a 14-day satisfaction guarantee for most course purchases. If you are not satisfied with a course, you may request a full refund within 14 days of purchase, provided you have completed less than 25% of the course content. Refund requests must be submitted through your account dashboard or by contacting our support team.

Live workshop sessions and studio workshops may have different cancellation policies due to their time-sensitive nature. Cancellations made more than 7 days before the scheduled session are eligible for a full refund or credit. Cancellations made within 7 days may receive a partial refund or credit at our discretion. No-shows are not eligible for refunds.

Ingredient kit purchases are final sale once shipped and cannot be refunded except in cases of damage during shipping or significant product defects. Membership fees are non-refundable but may be canceled to prevent future charges.

Intellectual Property Rights

All content provided through our platform, including but not limited to videos, recipes, written materials, images, logos, course curriculum, and instructional designs, is the intellectual property of Tsubaki Pastry Studio or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from our courses for commercial purposes without our express written permission. Personal use for your own learning and practice is permitted. Sharing of account credentials or course content with others is strictly prohibited and may result in account termination.

User-Generated Content

Our platform may allow you to post comments, share photos of your work, participate in discussion forums, and submit other content. You retain ownership of content you create, but by submitting it to our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for promotional and educational purposes.

You are solely responsible for the content you post and must ensure it does not violate any laws, infringe on third-party rights, or contain offensive, harmful, or inappropriate material. We reserve the right to remove any user-generated content that violates these Terms or our community guidelines.

Code of Conduct and Community Guidelines

We strive to maintain a respectful, supportive, and inclusive learning environment. You agree to treat instructors and fellow students with respect and courtesy. Harassment, discrimination, hate speech, bullying, or threatening behavior will not be tolerated and may result in immediate account suspension or termination.

You may not use our platform to engage in spam, fraudulent activities, or any conduct that disrupts or interferes with the services or other users' experiences. Academic integrity is expected in all certification programs, and plagiarism or cheating will result in disqualification from certificates.

Disclaimers and Limitation of Liability

Our educational services are provided "as is" and "as available" without warranties of any kind, either express or implied. While we strive for accuracy, we do not guarantee that course content is error-free, complete, or current. You acknowledge that results from following our recipes and techniques may vary based on factors including ingredient quality, equipment, skill level, and environmental conditions.

To the fullest extent permitted by law, Tsubaki Pastry Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim related to our services shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Tsubaki Pastry Studio, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to your violation of these Terms, your use of our services, or your violation of any rights of third parties.

Termination and Suspension

We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate. Upon termination, your right to access course materials will cease immediately, and you may be required to delete any downloaded content.

You may terminate your account at any time by contacting our support team. Upon voluntary termination, you will retain access to purchased courses through the end of your access period, but membership subscriptions and recurring billing will be canceled.

Third-Party Services and Links

Our platform may integrate with or link to third-party services, payment processors, video hosting platforms, and other external resources. We are not responsible for the availability, accuracy, or content of these third-party services, and your use of them is governed by their respective terms and policies. We encourage you to review the terms of any third-party services you access through our platform.

Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall first be addressed through good-faith negotiations. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in Osaka, Japan, except where prohibited by law.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in court to protect intellectual property rights or confidential information.

Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services, including course offerings, platform features, and pricing, at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services, except as required by applicable consumer protection laws.

Entire Agreement and Severability

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tsubaki Pastry Studio regarding your use of our services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
